Organizers of a new Oregon state initiative campaign, Oregon Cannabis Tax Act 2012 (OCTA2012), are announcing the kickoff of their petition drive and opening of their new office. The Oregon Secretary of State’s Election Division just announced the approval of the petition, Initiative Number 9, for circulation and signature gathering on March 24th. Revenue generated by the Oregon Cannabis Tax Act (OCTA) is three fold. The initial cash flow will be generated by the adult commercial sale of cannabis in retail stores in Oregon. This alone will create millions in revenue for the Oregon General Fund because 90 percent of the profits go directly to the General Fund. The chart below displays how the fund works. The remainder of the profits are set aside for drug treatment and education as well as setting up a state level committee for the promotion of industrial hemp. Hemp is the second tier of income from OCTA.

Certified Ballot Title


The Office of the Secretary of State received a certified ballot title from the Attorney General on February 24, 2011, for initiative petition #9, proposing a statutory amendment, for the General Election of November 6, 2012.

In addition, Secretary of State Kate Brown determined that the proposed initiative petition was in compliance with the procedural requirements established in the Oregon Constitution for initiative petitions.

The certified ballot title is as follows:

Allows personal marijuana, hemp cultivation/use without license; commission to regulate commercial marijuana cultivation/sale

Result of a “Yes” Vote: “Yes” vote allows commercial marijuana (cannabis) cultivation/sale to adults through state-licensed stores; allows unlicensed adult personal cultivation/use; prohibits restrictions on hemp (defined).

Result of a “No” Vote: “No” vote retains existing civil and criminal laws prohibiting cultivation, possession and delivery of marijuana; retains current statutes that permit regulated medical use of marijuana.
